Conditions of participation for competitions of the Braunschweiger Baugenossenschaft via Facebook and Instagram:

Object
1. These conditions of participation and data protection information govern participation in the competition organized by Braunschweiger Baugenossenschaft e.G., Celler Str. 66-69, 38114 Braunschweig (hereinafter referred to as the "Organizer") by the participants as well as the collection and use of the data collected or provided by the participants.
2. By participating in the competition, participants accept the following conditions of participation and data protection rules of Instagram and Facebook:
Conditions of participation in the competition
1. The competition ends at the time specified in the description.
2. Eligible to participate are persons who are resident in Germany and are at least 18 years old. Excluded are employees of the organizer and employees of cooperation partners who are or were involved in the creation or processing of the competition.
3. The prizes specified in the description will be raffled off among all participants.
4. The participation fee consists of the activity specified in the description.
5. The winners will be determined as specified in the description.
Rights of use, exemption and responsibility
1. The organizer is not obliged to check the content provided by the participants (e.g. images) for potential infringements of third-party rights. However, the Organizer shall be entitled to reject such content if, in its reasonable opinion, the content is unlawful or offends common decency.
2. By uploading content, in particular images, participants declare that the content is free of third-party rights, i.e. that it either originates from them or that they have obtained the consent of the authors and the persons depicted in the images and videos. Participants indemnify the organizer against all third-party claims arising from the content provided to participants. They agree to support the organizer in every reasonable way in defending against these claims.
3. By uploading your content, you voluntarily and free of charge grant the organizer the simple, non-exclusive, transferable, sublicensable right, unlimited in terms of space, time and content, to use, exploit and edit the content in all media forms and types of use for advertising purposes
4. The participants are aware that they can only revoke their above transfer of rights for good cause and that images are accessible worldwide on the Internet, e.g. via search engines, with other content.
Processing
1. A Payment of the prize in cash, in kind, its exchange or transfer to other persons is not possible. A participant may waive the prize. In this case, the next participant in the order of winners will take their place. The handover of the prizes will be agreed individually with the participants.
2. The winners will be notified of the prizes by direct message (DM) on Instagram, Facebook or by email to the email address provided or by post and asked for confirmation.
3. If a participant does not accept the prize within a period of 4 weeks, the prize will be forfeited. If the contact details provided are incorrect (e.g. invalid email addresses), the organizer is not obliged to search for correct addresses. The disadvantages resulting from the provision of incorrect contact details shall be borne by the participants.
Exclusion of warranty
1. The organizer points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints without this giving rise to any claims by participants against the organizer.
2. This may include technical problems, rule changes or decisions by platforms such as Facebook if the competition is held on or in connection with them.
Liability
1. The following exclusions and limitations of liability apply to the organizer's liability for damages, notwithstanding the other statutory requirements for claims in accordance with this section 6.
2. The Organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
3. Furthermore the Organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, the organizer is only liable for the foreseeable damage typical for the contract. The Organizer shall not be liable for the slightly negligent breach of obligations other than those mentioned in the above sentences.
4. The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act shall remain unaffected.
5. Insofar as the Organizer's liability is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents of the Organizer.
Data protection information
1. The Organizer shall only collect and use the data of the participants insofar as this is permitted by law or the participants consent to this. Any consent given can be revoked at any time with effect for the future.
2. We collect the following personal data for the processing of the competition: Name, e-mail address, postal address. This data will be used exclusively for notifying the winner and sending the prize.
3. Upon written or textual request, participants can request information from the organizer at any time about which personal data is stored by the organizer, can request its correction and deletion and can revoke data usage consent.
4. The data will be deleted within 30 days after the competition has been completed, provided that there are no legal storage obligations to the contrary.
Notes and conditions of Facebook and Instagram
1. In addition to these conditions of participation, the relationship between the organizer, the participant and Facebook and Instagram is determined by the following conditions of participation and data protection rules of Instagram and Facebook:
2. Participants may not assert any claims against Facebook that arise in connection with the use of the competition application or participation in the competition.
3. All information and data provided by or collected from participants through the use of the competition application or in the competition will be provided only to the organizer and not to Facebook.
4. All inquiries and notices regarding the competition should be directed to the organizer and not to Facebook or Instagram.
5. Participants acknowledge that neither the competition nor the competition application is sponsored, supported or organized by Meta, Instagram or Facebook.
6. Only their own profiles may be tagged. Tagging third parties without their consent is not permitted.
